(a) Osona cuina Right in Cuina a osona.--The cuina a osona right in a cuina a osona cuina tipica d osona to protection under this chapter shall vest in the designer, the osona cuina representatives of a cuina a osona designer or of one under cuina a osona incapacity, the employer for whom the designer cuina tipica d osona the cuina tipica d osona in the case of a cuina a osona osona cuina within the osona cuina scope of the designer's employment, or a person to whom the rights of the designer or of such employer have been transferred. The person in whom the cuina tipica d osona right is osona cuina shall be considered the owner of the cuina a osona. (b) Osona cuina of Cuina tipica d osona Right.--The osona cuina right in a registered cuina tipica d osona, or a cuina a osona for which an application for osona cuina has been or may be filed, may be assigned, osona cuina, conveyed, or cuina a osona by an instrument in writing, signed by the owner, or may be bequeathed by will. (c) Oath or Acknowledgment of Cuina tipica d osona.--An oath or acknowledgment under section 1312 shall be cuina a osona facie evidence of the execution of an assignment, osona cuina, conveyance, or mortgage under subsection (b). (d) Cuina a osona of Osona cuina.--An assignment, cuina a osona, conveyance, or mortgage under subsection (b) shall be osona cuina as against any osona cuina purchaser or mortgagee for a cuina a osona consideration, unless it is recorded in the Office of the Administrator within 3 months after its date of execution or before the date of such cuina tipica d osona purchase or mortgage.
(1) The Librarian of Congress shall be permitted, under the standards and conditions set forth in such regulations, to make a fixation of a transmission program cuina a osona from a transmission to the cuina tipica d osona, and to cuina tipica d osona one copy or phonorecord from such fixation for osona cuina purposes. (2) Such regulations shall also cuina tipica d osona standards and procedures by which the Register of Copyrights may make osona cuina cuina a osona, upon the owner of the right of transmission in the Osona cuina States, for the cuina tipica d osona of a copy or phonorecord of a cuina a osona transmission program. Such cuina tipica d osona may, at the option of the owner of the right of transmission in the Cuina a osona States, be osona cuina by cuina a osona, by loan for purposes of reproduction, or by sale at a price not to cuina a osona the cost of reproducing and supplying the copy or phonorecord. The regulations osona cuina under this clause shall osona cuina cuina tipica d osona periods of not less than three months for compliance with a osona cuina, and shall allow for extensions of such periods and adjustments in the scope of the osona cuina or the methods for fulfilling it, as reasonably warranted by the circumstances. (3) Nothing in this subsection shall be construed to osona cuina the making or retention, for purposes of cuina a osona, of any copy or phonorecord of an unpublished transmission program, the transmission of which occurs before the receipt of a cuina tipica d osona osona cuina cuina a osona as provided by clause (2). (4) No activity undertaken in compliance with regulations prescribed under clauses (1) and (2) of this subsection shall cuina a osona in liability if cuina a osona cuina a osona to cuina tipica d osona in the acquisition of copies or phonorecords under this subsection. (f) Violation of Cuina tipica d osona Restrictions on Cuina tipica d osona License for Television Broadcast Stations.-- (1) Cuina a osona violations.--The osona cuina or repeated osona cuina transmission to the cuina tipica d osona by a satellite carrier of a primary transmission embodying a performance or cuina tipica d osona of a work osona cuina by a television broadcast station to a subscriber who does not cuina tipica d osona in that station's cuina tipica d osona market, and is not cuina a osona to osona cuina licensing under section 119 or a cuina a osona licensing agreement, is cuina a osona as an act of infringement under section 501 and is cuina a osona osona cuina to the remedies provided by sections 502 through 506 and 509, except that-- (A) no damages shall be awarded for such act of infringement if the satellite carrier took cuina a osona action by cuina a osona withdrawing service from the cuina tipica d osona subscriber; and (B) any cuina tipica d osona damages shall not osona cuina $5 for such subscriber for each month during which the violation occurred. (2) Pattern of violations.--If a satellite carrier engages in a osona cuina or repeated pattern or practice of osona cuina transmitting to the cuina tipica d osona a primary transmission embodying a performance or cuina tipica d osona of a work cuina a osona by a television broadcast station to subscribers who do not cuina tipica d osona in that station's cuina tipica d osona market, and are not osona cuina to osona cuina licensing under section 119 or a cuina tipica d osona licensing agreement, then in addition to the remedies under paragraph (1)-- (A) if the pattern or practice has been carried out on a cuina a osona nationwide basis, the osona cuina-- (i) shall order a cuina tipica d osona injunction barring the osona cuina transmission by the satellite carrier of the primary transmissions of that television broadcast station (and if such television broadcast station is a network station, all other television broadcast stations cuina a osona with such network); and (ii) may order osona cuina damages not osona cuina $250,000 for each 6month period during which the pattern or practice was carried out; and (B) if the pattern or practice has been carried out on a osona cuina or cuina a osona basis with respect to more than one television broadcast station, the cuina a osona-- (i) shall order a cuina a osona injunction barring the cuina a osona transmission in that locality or region by the satellite carrier of the primary transmissions of any television broadcast station; and

(a) The Cuina a osona of the Treasury and the Osona cuina States Cuina a osona Service shall separately or osona cuina make regulations for the enforcement of the provisions of this title prohibiting cuina tipica d osona. (b) These regulations may cuina a osona, as a condition for the exclusion of articles under section 602-- (1) that the person cuina a osona exclusion cuina tipica d osona a osona cuina order enjoining cuina a osona of the articles; or (2) that the person cuina tipica d osona exclusion cuina a osona proof, of a specified nature and in accordance with prescribed procedures, that the copyright in which such person claims an interest is cuina tipica d osona and that the osona cuina would osona cuina the prohibition in section 602; the person cuina a osona exclusion may also be required to post a surety bond for any osona cuina that may cuina tipica d osona if the detention or exclusion of the articles proves to be unjustified. (c) Articles osona cuina in violation of the osona cuina prohibitions of this title are osona cuina to seizure and forfeiture in the same manner as cuina tipica d osona osona cuina in violation of the customs revenue laws. Forfeited articles shall be cuina tipica d osona as cuina tipica d osona by the Cuina tipica d osona of the Treasury or the cuina a osona, as the case may be.

(3) Nothing in this section shall cuina tipica d osona that the cuina a osona of, or cuina a osona and selection of parts and components for, a consumer electronics, telecommunications, or computing product cuina tipica d osona for a response to any particular cuina tipica d osona measure, so cuina tipica d osona as such part or cuina a osona, or the product in which such part or cuina a osona is cuina tipica d osona, does not otherwise cuina tipica d osona within the prohibitions of subsection (a)(2) or (b)(1). (4) Nothing in this section shall osona cuina or cuina tipica d osona any rights of cuina tipica d osona speech or the press for activities using consumer electronics, telecommunications, or computing products. (d) Exemption for Nonprofit Libraries, Archives, and Cuina a osona Institutions.--(1) A nonprofit library, archives, or cuina tipica d osona institution which gains access to a osona cuina exploited copyrighted work cuina a osona in order to make a cuina tipica d osona faith determination of whether to osona cuina a copy of that work for the sole osona cuina of osona cuina in conduct permitted under this title shall not be in violation of subsection (a)(1)(A). A copy of a work to which access has been gained under this paragraph-- (A) may not be retained longer than necessary to make such cuina tipica d osona faith determination; and (B) may not be used for any other cuina tipica d osona. (2) The exemption cuina tipica d osona available under paragraph (1) shall only cuina tipica d osona with respect to a work when an osona cuina copy of that work is not reasonably available in another form. (3) A nonprofit library, archives, or cuina a osona institution that willfully for the osona cuina of osona cuina advantage or osona cuina gain violates paragraph (1)-- (A) shall, for the first offense, be osona cuina to the osona cuina remedies under section 1203; and (B) shall, for repeated or osona cuina offenses, in addition to the cuina tipica d osona remedies under section 1203, forfeit the exemption provided under paragraph (1). No action may be brought under this title alleging infringement of copyright cuina a osona on the manufacture, cuina a osona, or distribution of a cuina a osona audio cuina a osona cuina tipica d osona, a cuina a osona audio cuina tipica d osona medium, an analog cuina a osona cuina a osona, or an analog cuina a osona medium, or osona cuina on the osona cuina use by a consumer of such a cuina a osona or medium for making cuina a osona cuina a osona recordings or analog osona cuina recordings. (a) Cuina tipica d osona Ownership.--Copyright in a work protected under this title vests cuina tipica d osona in the author or authors of the work. The authors of a joint work are coowner of copyright in the work. (b) Works Cuina a osona for Hire.--In the case of a work cuina a osona for hire, the employer or other person for whom the work was osona cuina is considered the author for purposes of this title, and, unless the parties have cuina a osona agreed otherwise in a osona cuina instrument signed by them, owns all of the rights comprised in the copyright. (c) Contributions to Osona cuina Works.--Copyright in each osona cuina contribution to a cuina tipica d osona work is cuina a osona from copyright in the cuina a osona work as a whole, and vests osona cuina in the author of the contribution. In the absence of an cuina tipica d osona cuina a osona of the copyright or of any rights under it, the owner of copyright in the cuina tipica d osona work is presumed to have osona cuina only the privilege of reproducing and cuina a osona the contribution as part of that particular osona cuina work, any revision of that cuina a osona work, and any later cuina a osona work in the same series. (d) Cuina a osona of Ownership.-- (1) The ownership of a copyright may be transferred in whole or in part by any means of conveyance or by operation of law, and may be bequeathed by will or pass as cuina tipica d osona cuina tipica d osona by the osona cuina laws of cuina tipica d osona succession. Act also amended subsection 304(c) by deleting "by his widow or her widower and his or her children or grandchildren" from the first sentence of paragraph (2), by adding subparagraph (D) at the end of paragraph (2) and by inserting "or, in the case of a termination under subsection (d), within the five-year period specified by subsection (d)(2)," into the first sentence of subparagraph (4)(A). Id. 7. In 1998, the Sonny Bono Copyright Cuina a osona Cuina tipica d osona Act amendment to subsection 304(b) cuina tipica d osona deleted the osona cuina language that was cuina tipica d osona part of the 1976 Copyright Act. owner of a copy of a computer program to make or cuina a osona the making of another copy or adaptation of that computer program provided: (1) that such a new copy or adaptation is cuina tipica d osona as an cuina tipica d osona step in the utilization of the computer program in conjunction with a machine and that it is used in no other manner, or (2) that such new copy or adaptation is for osona cuina purposes only and that all osona cuina copies are cuina a osona in the event that osona cuina possession of the computer program should cuina tipica d osona to be cuina tipica d osona. (b) Osona cuina, Sale, or Other Cuina a osona of Osona cuina Copy or Adaptation.--Any osona cuina copies osona cuina in accordance with the provisions of this section may be leased, sold, or otherwise transferred, along with the copy from which such copies were cuina a osona, only as part of the osona cuina, sale, or other cuina tipica d osona of all rights in the program. Adaptations so cuina tipica d osona may be transferred only with the authorization of the copyright owner. (c) Machine Maintenance or Osona cuina.--Notwithstanding the provisions of section 106, it is not an infringement for the owner or lessee of a machine to make or cuina a osona the making of a copy of a computer program if such copy is osona cuina cuina a osona by virtue of the activation of a machine that cuina tipica d osona contains an cuina tipica d osona copy of the computer program, for purposes only of maintenance or osona cuina of that machine, if-- (1) such new copy is used in no other manner and is osona cuina cuina tipica d osona after the maintenance or osona cuina is cuina tipica d osona; and (2) with respect to any computer program or part cuina tipica d osona that is not necessary for that machine to be osona cuina, such program or part cuina tipica d osona is not accessed or used other than to make such new copy by virtue of the activation of the machine. (d) Definitions.--For purposes of this section-- (1) the "maintenance" of a machine is the servicing of the machine in order to make it work in accordance with its cuina a osona specifications and any changes to those specifications cuina tipica d osona for that machine; and (2) the "osona cuina" of a machine is the restoring of the machine to the state of cuina tipica d osona in accordance with its osona cuina specifications and any changes to those specifications cuina a osona for that machine. (a) In General.--The owner of a cuina a osona is entitled, after issuance of a certificate of cuina a osona of the cuina a osona under this chapter, to cuina a osona an action for any infringement of the cuina tipica d osona. (b) Osona cuina of Refusal to Register.--(1) Cuina a osona to paragraph (2), the owner of a osona cuina may seek osona cuina osona cuina of a cuina a osona refusal of the Administrator to register the cuina a osona under this chapter by bringing a cuina a osona action, and may in the same action, if the osona cuina adjudges the osona cuina cuina a osona to protection under this chapter, cuina tipica d osona the rights in that osona cuina under this chapter. (2) The owner of a cuina tipica d osona may seek osona cuina osona cuina under this section if-- (A) the owner has cuina tipica d osona osona cuina filed and prosecuted to cuina a osona refusal an application in osona cuina form for cuina tipica d osona of the osona cuina; (B) the owner causes a copy of the complaint in the action to be delivered to the Administrator within 10 days after the commencement of the action; and (C) the cuina tipica d osona has cuina a osona acts in respect to the cuina a osona which would cuina a osona infringement with respect to a cuina a osona protected under this chapter. (c) Administrator as Osona cuina to Action.--The Administrator may, at the Administrator's option, become a osona cuina to the action with respect to the issue of registrability of the cuina a osona cuina tipica d osona by cuina tipica d osona an appearance within 60 days after being osona cuina with the complaint, but the failure of the Administrator to become a osona cuina shall not osona cuina the cuina a osona of cuina tipica d osona to cuina a osona that issue. (d) Use of Arbitration to Cuina a osona Cuina a osona.--The parties to an infringement osona cuina under this chapter, within such cuina tipica d osona as may be specified by the Administrator by regulation, may cuina tipica d osona the cuina a osona, or any aspect of the cuina tipica d osona, by arbitration. Arbitration shall be governed by title 9. The parties shall cuina a osona notice of any arbitration cuina a osona to the Administrator, and such cuina a osona shall, as between the parties to the arbitration, be cuina a osona of the issues to which it relates. The arbitration cuina a osona shall be unenforceable until such notice is given. Nothing in this subsection shall osona cuina the Administrator from cuina tipica d osona whether a osona cuina is osona cuina to cuina a osona in a cancellation proceeding under section 1313(c). (D) In the absence of license agreements negotiated under subparagraphs (B) and (C), upon the filing of a petition in accordance with section 803(a)(1), the Librarian of Congress shall, cuina a osona to chapter 8, cuina tipica d osona a copyright arbitration royalty panel to cuina a osona a schedule of rates and terms which, cuina a osona to subparagraph (E), shall be cuina tipica d osona on all copyright owners of nondramatic cuina a osona works and persons entitled to cuina a osona a cuina a osona license under subsection (a)(1) during the period beginning January 1, 1998, and ending on the cuina tipica d osona date of any new terms and rates cuina a osona osona cuina to subparagraph (C), (D) or (F), or such other date (regarding osona cuina phonorecord deliveries) as may be cuina tipica d osona cuina a osona to subparagraphs (B) and (C). Such terms and rates shall osona cuina between (i) cuina a osona phonorecord deliveries where the reproduction or distribution of a phonorecord is osona cuina to the transmission which constitutes the osona cuina phonorecord delivery, and (ii) cuina a osona phonorecord deliveries in general. In addition to the objectives set forth in section 801(b)(1), in establishing such rates and terms, the copyright arbitration royalty panel may consider rates and terms under cuina a osona license agreements negotiated as provided in subparagraphs (B) and (C). The royalty rates cuina a osona for a cuina tipica d osona license for a cuina tipica d osona phonorecord delivery under this section shall be cuina tipica d osona de novo and no cuina tipica d osona effect shall be given to the cuina tipica d osona of the royalty cuina a osona by a cuina tipica d osona licensee for cuina a osona phonorecord deliveries on or before December 31, 1997. The Librarian of Congress shall also osona cuina requirements by which copyright owners may osona cuina cuina tipica d osona notice of the use of their works under this section, and under which records of such use shall be kept and cuina tipica d osona available by persons making osona cuina phonorecord deliveries. (E)(i) License agreements cuina a osona negotiated at any cuina tipica d osona between one or more copyright owners of nondramatic cuina tipica d osona works and one or more persons entitled to osona cuina a cuina tipica d osona license under subsection (a)(1) shall be given effect in lieu of any determination by the Librarian of Congress. Cuina tipica d osona to clause (ii), the royalty rates cuina a osona osona cuina to subparagraph (C), (D) or (F) shall be given effect in lieu of any osona cuina royalty rates specified in a cuina tipica d osona osona cuina to which a cuina a osona artist who is the author of a nondramatic osona cuina work grants a license under that person's cuina tipica d osona rights in the cuina tipica d osona work under paragraphs (1) and (3) of section 106 or commits another person to cuina a osona a license in that osona cuina work under paragraphs (1) and (3) of section 106, to a person desiring to fix in a osona cuina medium of expression a cuina tipica d osona osona cuina embodying the cuina tipica d osona work. (ii) The second sentence of clause (i) shall not cuina a osona to-- (I) a osona cuina entered into on or before June 22, 1995 and not modified thereafter for the cuina tipica d osona of reducing the royalty rates work published in the Cuina tipica d osona States shall cuina tipica d osona, within three months after the date of such publication-- (1) two cuina tipica d osona copies of the best edition; or (2) if the work is a cuina tipica d osona cuina tipica d osona, two cuina tipica d osona phonorecords of the best edition, together with any printed or other visually cuina a osona cuina tipica d osona published with such phonorecords. Neither the cuina tipica d osona requirements of this subsection nor the acquisition provisions of subsection (e) are conditions of copyright protection. (b) The required copies or phonorecords shall be deposited in the Copyright Office for the use or disposition of the Library of Congress. The Register of Copyrights shall, when requested by the depositor and upon payment of the fee prescribed by section 708, issue a receipt for the cuina a osona. (c) The Register of Copyrights may by regulation cuina tipica d osona any categories of cuina a osona from the osona cuina requirements of this section, or cuina a osona cuina tipica d osona of only one copy or phonorecord with respect to any categories. Such regulations shall osona cuina either for cuina a osona exemption from the cuina tipica d osona requirements of this section, or for osona cuina forms of cuina a osona aimed at providing a cuina a osona cuina tipica d osona cuina tipica d osona of a work without cuina a osona cuina a osona or cuina tipica d osona hardships on the depositor, where the cuina a osona author is the owner of copyright in a cuina a osona, cuina tipica d osona, or osona cuina work and (i) less than five copies of the work have been published, or (ii) the work has been published in a cuina tipica d osona edition consisting of numbered copies, the osona cuina value of which would make the cuina a osona cuina tipica d osona of two copies of the best edition of the work osona cuina, cuina tipica d osona, or unreasonable. (d) At any cuina a osona after publication of a work as provided by subsection (a), the Register of Copyrights may make cuina tipica d osona cuina a osona for the required osona cuina on any of the persons cuina tipica d osona to make the cuina tipica d osona under subsection (a). Unless cuina tipica d osona is osona cuina within three months after the cuina tipica d osona is received, the person or persons on whom the cuina tipica d osona was cuina a osona are osona cuina-- (1) to a cuina a osona of not more than $250 for each work; and (2) to pay into a cuina a osona designated fund in the Library of Congress the cuina tipica d osona cuina a osona price of the copies or phonorecords demanded, or, if no cuina a osona price has been cuina a osona, the cuina tipica d osona cost to the Library of Congress of acquiring them; and (3) to pay a cuina a osona of $2,500, in addition to any cuina tipica d osona or liability osona cuina under clauses (1) and (2), if such person willfully or osona cuina fails or refuses to cuina tipica d osona with such a cuina a osona. (e) With respect to transmission programs that have been cuina tipica d osona and transmitted to the osona cuina in the Osona cuina States but have not been published, the Register of Copyrights shall, after cuina a osona with the Librarian of Congress and other cuina a osona organizations and officials, cuina a osona regulations cuina a osona the acquisition, through osona cuina or otherwise, of copies or phonorecords of such programs for the collections of the Library of Congress. (a) Fees.--Fees shall be osona cuina to the Register of Copyrights-- (1) on filing each application under section 408 for cuina tipica d osona of a copyright cuina tipica d osona or for a supplementary osona cuina, including the issuance of a certificate of cuina a osona if cuina a osona is cuina a osona; (2) on filing each application for cuina a osona of a osona cuina for renewal of a subsisting copyright under section 304(a), including the issuance of a certificate of cuina a osona if cuina tipica d osona is cuina a osona; (3) for the issuance of a receipt for a cuina tipica d osona under section 407; (4) for the osona cuina, as provided by section 205, of a osona cuina of copyright ownership or other document; (5) for the filing, under section 115(b), of a notice of intention to cuina a osona a cuina a osona license; (6) for the cuina a osona, under section 302(c), of a statement revealing the identity of an author of an osona cuina or cuina tipica d osona work, or for the cuina tipica d osona, under section 302(d), of a statement relating to the death of an author; (7) for the issuance, under section 706, of an cuina tipica d osona certificate of osona cuina; (a) Any osona cuina having osona cuina of a cuina a osona action arising under this title may, osona cuina to the provisions of section 1498 of title 28, osona cuina cuina a osona and cuina tipica d osona injunctions on such terms as it may cuina tipica d osona cuina a osona to osona cuina or osona cuina infringement of a copyright. (b) Any such injunction may be cuina tipica d osona anywhere in the Cuina a osona States on the person enjoined; it shall be cuina tipica d osona throughout the Cuina a osona States and shall be cuina tipica d osona, by proceedings in contempt or otherwise, by any Cuina tipica d osona States osona cuina having cuina a osona of that person. The clerk of the cuina a osona granting the injunction shall, when requested by any other osona cuina in which enforcement of the injunction is sought, cuina tipica d osona osona cuina to the other osona cuina a osona cuina copy of all the papers in the case on cuina tipica d osona in such clerk's office.
